Secure Dumpster™ Plan Set License and Purchase Terms — Version 1.0 (October 23, 2026)

Secure Dumpster™ Standard Plan Set License and Purchase Terms

Version 1.0 | October 23, 2026

Seller: Steel Building USA, Inc., doing business as Secure Dumpster™ ("SBUSA")

These terms govern the purchase and use of the Secure Dumpster™ standard enclosure drawing package. The checkout order confirmation identifies the buyer, site address, purchased package, price, and order number. The buyer must accept these terms before paying.

1. License grant and project identification

Upon cleared payment and delivery, SBUSA grants the named buyer a nonexclusive, limited, nontransferable license to use one copy of the purchased design package to obtain permits for, construct, and maintain ONE physical Secure Dumpster™ enclosure at the ONE street address identified at checkout. A double-bin enclosure is one physical enclosure. A second structure, even on the same parcel, requires another license unless separately authorized in writing by SBUSA. If the buyer purchases a five-project pack, the purchase provides five distinct ONE-physical-enclosure/ONE-registered-location licenses (two separate physical enclosures at one property require two individually identified licenses); each license is issued separately after the buyer identifies the site and configuration. A five-project pack is not an unrestricted reusable copy of the drawings. Municipal or agency program licenses require their own signed written agreement specifying jurisdiction, term, maximum site registrations and authorized users; these standard one-site terms do not grant unlimited municipal reuse. The license does not authorize production, resale, adaptation or construction at another property. The license continues for the designated project while the buyer complies with these terms.

2. Permitted project use

The buyer may make copies reasonably necessary for the one authorized project, furnish them to the buyer’s retained architect, engineer, licensed contractor, suppliers and building officials solely for that project, submit them for plan review, and retain records for later inspection and maintenance at the approved site. Any recipient must be informed that the materials are limited to the named site and may not be reused elsewhere. Buyer remains responsible for the handling of materials by its agents.

3. Files included

The licensed architectural PDF includes CS (Project Overview), A1 (SD-D double new build), A2 (SD-RD double retrofit), A3 (SD-S single new build), A4 (SD-R single retrofit), and D1 (Gate and Trim Details). The package separately includes digitally signed structural sheets S0, S1.0, S2.0 and S2.1 and digitally signed structural calculations by Wynn Engineering, Inc., Job 26-603. The separate signed structural files govern over any reference copies included inside the architectural PDF. The package covers four standard configurations but authorizes construction of only the one selected physical enclosure at the order address.

4. Materials not included

Not included: property-specific site or plot plan; survey or boundary verification; geotechnical or soils report; project-specific seismic design hazard report; civil grading, drainage or plumbing documents; utility design; fire or accessibility analysis; permitting fees; local agency fees; field verification; and construction labor or materials. These may be required for a permit or construction and are the buyer’s responsibility or may be separately quoted.

5. Standard design limits

The engineer’s signed sheets S0 and S1.0 are controlling. The summary below is informational, not a substitute for the signed drawings. Design basis: 2025 California Building Code and ASCE/SEI 7-22; Risk Category II; ultimate wind speed up to 100 mph, Exposure B or C; mapped short-period seismic spectral acceleration Ss no greater than 2.75 with footing tier selected per S1.0; Site Class D (default) or better; minimum allowable soil bearing 1,500 psf; ground snow load zero; maximum enclosure height 10 feet; and gate weight not over 500 pounds per S1.0. Retrofit envelope: SD-RD up to 22 feet 4 inches by 12 feet; SD-R up to 10 feet 8 inches by 12 feet. Other dimensions and structural conditions are governed by the signed sheets. A location outside any specified limit, or subject to more demanding applicable code requirements, needs qualified site-specific engineering and may not use this standard structural package unchanged.

6. Site review, permits, and construction responsibility

The buyer and the professionals retained by the buyer must verify zoning, current local code requirements and amendments, wind/seismic/snow values, site class and soil capacity, fire-department access, accessibility, setbacks, stormwater and refuse requirements, existing footing/slab/block-wall condition, anchorage, property boundaries, utilities, and actual dimensions. Permit issuance is solely up to the authority having jurisdiction. Buyer must obtain applicable permits and approvals and use appropriately licensed professionals and contractors. The plan set is not a permit, an approval, a warranty of code compliance for any site, or a substitute for site-specific professional judgment. The buyer is responsible for field changes and installed-work quality.

7. Integrity of the engineering documents

Wynn Engineering’s two digitally signed PDFs must be supplied and submitted exactly as provided. Do not edit, stamp, annotate, compress, merge, split, re-save, convert, print-to-PDF, or otherwise process those signed PDFs in a way that might invalidate the signatures. The standard architectural drawing PDF and the two original digitally signed Wynn PDFs are supplied unchanged to each authorized buyer. Buyer, order, registered site, enclosure identifier and model details are maintained in a separate site-license record and printable verification, not stamped onto or regenerated within the reusable PDF files. Any structural revision or additional engineering must be separately prepared and signed by an appropriately authorized professional; it must not be passed off as a revision of Wynn’s original digitally signed file.

8. Restrictions and intellectual property

SBUSA retains its rights in the architectural documents. Wynn Engineering, Inc. retains its rights in the structural documents, distributed under authorization to SBUSA. Purchase transfers no copyright or design ownership. Except for permitted project use in Section 2, the buyer may not publicly post, redistribute, sublicense, sell, transfer, extract, trace, or reproduce substantial protected portions of the drawings, remove proprietary notices, or use the set as a template to build additional structures. The terms do not prohibit independent design work that does not misuse protected material or rights granted by law. Use outside the paid license may result in termination of further permitted use and legal remedies available under applicable law; no particular damages award is guaranteed.

9. Price, payment, delivery, and no recurring fees

The total price, taxes where applicable, and any expressly selected optional services are shown before payment. This purchase grants a single project-use license and does not create a subscription or recurring charge. The order confirmation identifies the designated site and package. The same reusable standard plan-package ZIP is delivered by an access-controlled link after verified payment and recording of the applicable buyer and physical-enclosure site license. Link expiration or download limits restrict delivery access, not the scope or duration of the buyer’s valid one-project license. Upon reasonable identity and order verification, SBUSA may reissue access for the same project. Delivery commitment: For a complete and eligible one-site order, SBUSA supplies the unchanged reusable standard architectural set, original digitally signed structural drawings, and original signed structural calculations together in a protected ZIP after verified, cleared Stripe payment. The purchaser’s one-enclosure site license is recorded separately; the plan files themselves are not regenerated. For a five-site package, the purchaser receives a protected registration link; each of the five physical enclosures receives a separate site-license record and secure access to that same reusable plan-package ZIP after its address, model and enclosure identifier have been registered. Files are not mailed. Instant delivery is contingent upon complete and accurate information and the buyer’s acknowledgment of the standard design limitations; it does not constitute an engineering review, a site-specific determination, or permit approval. When site information is missing, inconsistent or outside the standard limitations, automatic delivery is held and SBUSA contacts the purchaser within two business days to discuss correction, additional engineering or cancellation. The buyer’s full pre-delivery cancellation and refund rights described below remain in effect.

10. Cancellation, refunds, and defects

Before the licensed digital package has been delivered or made available to the buyer, a buyer may request cancellation for a full refund by emailing ronw@steelbuildingusa.com with the order number. After the licensed package has been delivered or made available, purchases are generally final for a change of mind because a digital copy has been provided. If the files are materially defective, incomplete, corrupted, or materially different from the advertised package, contact SBUSA for correction, replacement, or an appropriate refund. Any refund, cancellation, chargeback, or consumer protection right that cannot lawfully be waived remains available. No refund policy limits statutory rights. Separately quoted professional services, kits, or construction are governed by their own written agreements.

11. Additional work and future revisions

Site-specific engineering, plan-check comment responses, custom sizes, engineering redesign, fabricated materials/kits, and installation are separate paid offerings unless clearly included in the checkout order. Later revisions to codes or standard plans do not automatically include a new engineered package for an old purchase. If SBUSA discovers that files delivered at sale are missing or materially deficient relative to the package sold, SBUSA will work to correct the delivered package or provide an appropriate refund.

FULL MATERIALS CREDIT COMMITMENT. For every paid standard one-site plan license, Steel Building USA, Inc. dba Secure Dumpster™ will credit 100% of the actual plan-license purchase price paid by the buyer (excluding any plan-order taxes, refunded amounts, or discounts) toward Secure Dumpster™ physical materials ordered directly from SBUSA for the SAME licensed enclosure at the SAME identified construction site. This full face-value credit is available for eligible materials orders after purchase of the plan license. The credit has NO EXPIRATION DATE and requires NO MINIMUM MATERIALS ORDER. It is applied against the eligible materials merchandise subtotal, before taxes and freight, and can be redeemed across more than one eligible materials order until its full balance has been used. For example, a $495 paid plan license produces $495 total materials credit. If the first eligible material order is $200 before tax/freight, $200 is applied and $295 remains available for later eligible materials ordered for that enclosure. If a five-site package is purchased for $1,495, the materials credit is allocated equally among five separately registered project licenses, $299 per site. No site’s share can be moved to another licensed site, but any unused share carries forward for later qualifying material orders for that same enclosure. The buyer must provide its plan order number so the credit can be applied and traced. SBUSA must honor the full remaining credit against later qualifying materials orders for the same licensed project. Credit cannot be exchanged for cash, used for labor, installation, independent engineering, permit fees, shipping, freight, or taxes, transferred to another site or buyer, or applied to unrelated products. A credit is not added to the buyer’s account until the plan purchase is paid and is reduced by any portion already redeemed. If an eligible materials order is cancelled or refunded, its used credit balance is reinstated to the extent that merchandise purchase is reversed. If the underlying plan purchase is refunded or charged back, unused credit is cancelled and any credit already redeemed may be adjusted against amounts otherwise owed, subject to applicable law. Direct purchasers of a qualifying Secure Dumpster materials kit that already includes the standard drawings are not separately charged again for those standard plans. Any additional project-specific engineering is separately quoted and is not part of this materials credit.

12. Disclaimer and allocation of risk

To the maximum extent allowed by law, SBUSA provides a standard design package for evaluation and project-specific professional review, not a promise that any authority will approve it or that it will suit every site. SBUSA does not perform the buyer’s site investigation, permitting or construction through this digital plan license. Except for rights that cannot legally be excluded, SBUSA disclaims implied warranties of fitness for a particular site’s unique conditions. To the extent permitted by applicable law, liability arising solely from the plan-license transaction will not exceed the price actually paid for that license, and neither party is responsible for speculative or consequential losses. These provisions do not exclude or limit liabilities or remedies where such exclusion is unlawful, including for fraud, willful misconduct, or other nonwaivable claims.

13. Communications, governing law, and acceptance

California law governs this purchase to the extent not displaced by mandatory law. Subject to applicable consumer and jurisdictional protections, disputes may be brought in a court with appropriate jurisdiction in Riverside County, California. If any term is unenforceable, the remainder remains in effect to the extent permitted by law. The order confirmation and any signed site-specific change form supplement these terms; changes to the license scope require written agreement from SBUSA. The buyer accepts this agreement by affirmatively selecting the required, initially unchecked terms-of-service acceptance checkbox at checkout, reviewing the accompanying Secure Dumpster™ Plan Set License and Purchase Terms (version 1.0) disclosure, and submitting the purchase. The date, terms version, order, site address and acceptance record should be retained by SBUSA. No checkbox may be preselected.
